Spkr End User License Agreement (EULA)

1. License Grant

Spkr grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in accordance with this Agreement and our Terms of Service and Privacy Policy.

2. Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, or extract source code from the App.
• Use the App for commercial purposes, resale, or public broadcasting.
• Circumvent any technical protection or access restrictions in the App.
• Share your personal podcast feed or content with others.

3. Content Responsibility

You are solely responsible for any content you upload or submit through the App. You must ensure you have all necessary rights and permissions to use the content.

Podcast episodes generated from your content are for your personal use only and may not be shared, published, or rebroadcast.

4. Ownership

The App is licensed, not sold. All rights, title, and interest in and to the App, including intellectual property and content generated by the service (excluding your uploaded text), remain the property of No Friction Labs LLC.

5. Updates

Spkr may provide updates, patches, or changes to the App. These may be installed automatically or manually depending on your platform. This Agreement applies to all updates unless accompanied by a separate license.

6. Termination

This license terminates automatically if you violate any term of this Agreement. Upon termination, you must cease all use of the App and delete all copies from your devices. Spkr may suspend or disable access at its discretion.

7. Disclaimers

The App is provided "as is" without warranties of any kind. Spkr makes no representations or guarantees about:

• Accuracy or reliability of generated audio
• Compatibility with your devices
• Uninterrupted or error-free operation

8. Limitation of Liability

To the maximum extent permitted by law, Spkr shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, content, or profits
• Unauthorized access to your account or feed

Our liability is limited to the amount you paid (if any) for the App.

9. Apple App Store Terms

If you obtained the App from the Apple App Store, the following additional terms apply:

Scope of License

This license is limited to a non-transferable right to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. This license includes the right to use the App under Apple's Volume Purchase Program and Family Sharing features where applicable.

Maintenance and Support

No Friction Labs LLC is solely responsible for providing maintenance and support services for the App as specified in this EULA. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty

To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the App. Any claims, losses, liabilities, damages, costs or expenses attributable to any failure of the App to conform to any warranty will be the sole responsibility of No Friction Labs LLC. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). Apple will have no other warranty obligation whatsoever with respect to the App.

Product Claims

No Friction Labs LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:

• Product liability claims
• Any claim that the App fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, No Friction Labs LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by this EULA.

Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

Google Play Store

If you obtained the App from Google Play, your use is subject to Google Play's Terms of Service. Google is not responsible for the App, its content, maintenance, support services, or any claims relating to the App.

10. Governing Law

This Agreement is governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Denver, Colorado.

11. Legal Compliance and Export Restrictions

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties, including the Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List
• You will comply with all applicable export laws and regulations of the United States and other applicable jurisdictions

You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You agree to comply with all export control laws and regulations applicable to the technology used or supported by the App.
